Right of Withdrawal

The user has the right to withdraw from the purchase made within 14 days from the delivery of the goods.

How to exercise the right of withdrawal: To exercise the right of withdrawal for products purchased exclusively on the Website, you must express your unequivocal decision to withdraw from the contract, within 14 calendar days, in one of the following ways:

  • If you choose to return the product through the Website's online store, you must contact our Customer Service at help@pumpinparadise.com to unequivocally express your decision to withdraw from the contract. Indicating the product or products to be returned, attaching a photograph and a detailed list of the defects observed in them.  

The right of withdrawal shall be deemed exercised within the deadline when we have received your communication regarding the exercise of this right before the corresponding deadline ends, under the terms indicated above.

Consequences of withdrawal: In the event that you exercise the right of withdrawal, we will refund all payments we have received from you, excluding delivery costs, without undue delay and, in any case, no later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. We will proceed to make said refund using the same means of payment in which the purchase was made without incurring any costs as a result of the refund, except for the costs of returning the product. 

The products to be returned must be in perfect condition. If this is not the case, this withdrawal cannot be exercised.

PUMP IN PARADISE is not responsible for the courier company that the User contracts for the return of the order. PUMP IN PARADISE recommends that the User request the courier company to provide them with proof of delivery once the courier has deposited the product in the PUMP IN PARADISE offices/warehouses, so that the User has proof that the product has been delivered correctly to PUMP IN PARADISE.

The costs of returning the order (such as shipping costs through courier companies) shall be borne directly by the User.

(Example of exceptions to the right of withdrawal: except for those products that are defective or incorrectly supplied, the right of withdrawal shall not apply to contracts referring to:

~ Pre-sealed products that are not suitable for being returned for reasons of health protection or hygiene and that have been unsealed after delivery.

~ Products that may deteriorate or expire rapidly.

~ Products made to the consumer's specifications, custom-made or clearly personalized.

~ The supply of sealed audio or video recordings or sealed computer software that have been unsealed by the consumer and user after delivery.)  

EXTRAJUDICIAL RESOLUTION OF DISPUTES (RESOLUTION PROCEDURES)

Disputes between the parties that may arise from contracts concluded exclusively electronically may be settled extrajudicially through the online dispute resolution platform published by the European Commission, where all the necessary information to exercise the corresponding actions will be found.

JURISDICTION AND COMPETENCE

In the case of a consumer and user intervening, the parties submit, for the resolution of disputes arising from these general conditions of sale, to the Courts and Tribunals of the civil order corresponding to the consumer's domicile, by virtue of their specific regulations.

For all other intervening parties, territorial jurisdiction shall be determined by the general rules of distribution of jurisdiction, set forth in articles 50 and following of the Law of Civil Procedure.
